DataGuardian $150,000 Data Breach Protection Insurance Policy

Clearent’s DataGuardian compliance and security program helps you comply with the Payment Card Industry Data Security Standards (PCI DSS) so you can protect your business, your reputation and your customers from the devastating effects of a data breach. In addition to easy-to-understand self-assessment questionnaires and quarterly network scans, the program also includes a $150,000 Data Breach Protection Insurance Policy.* This policy helps you rest easy knowing that you’re protected in the event of a breach.


Coverage Summary


The $150,000 Data Breach Protection Insurance Policy covers:

  • Cost of the mandatory forensic audit
  • Card replacement costs and related expenses
  • PCI DSS and regulatory fines and assessments resulting from a breach
  • Cost of Account Data Compromise Recovery (ADCR) fines for credit card fraud
  • EMV payment acceptance and software and hardware upgrades when ordered by the card associations in lieu of a fine [$10,000 limit per Merchant Identification Number (MID) and $25,000 limit per merchant for those with multiple locations]
  • Breach notification expenses ($10,000 limit)
    • Drafting of notification letters
    • Printing and mailing expense
    • Required media notifications (newspaper or radio announcement)

Additional Program Details

  • There is no deductible.
  • The program covers breaches of a system/network or the physical theft of credit card data from stolen receipts, stolen computers, skimming, or even employee theft (excluding director level and above).
  • Single location merchants, meaning those with one MID, are protected up to a maximum of $150,000 per program year. 
  • Merchants with multiple locations (multiple MIDs) are protected up to a maximum of $500,000 per program year. Each MID is covered up to $150,000 until the total program benefit is reached.
  • The policy covers all PCI DSS Level 2, Level 3 and Level 4 merchants, regardless of whether they were compliant at the time of the breach.
  • If a merchant experiences a breach, they must become compliant before they can participate in (or re-enter) the program.
  • In the event of a breach, merchants are typically reimbursed within 30 days, providing they submit the necessary documentation.
